TERMS OF USE, SALES POLICY, PRODUCT DISCLAIMER & BINDING ARBITRATION AGREEMENT

Effective Date: October 24, 2026

1. ACCEPTANCE OF TERMS

Welcome to MyOrigami.com (“Website”). These Terms of Use govern your access to and use of the Website and all purchases, products, custom orders, and services offered through MyOrigami.com.

By accessing the Website, placing an order, submitting a custom request, or purchasing a product, you acknowledge that you have read and agreed to these Terms, to the extent permitted by applicable law.

If you do not agree to these Terms, do not use the Website or place an order.

2. DEFINITIONS

For purposes of these Terms:

  • “Company,” “we,” “us,” or “our” refers to MyOrigami.com and the business operating the Website.

  • “Customer,” “you,” or “your” refers to any person accessing the Website or purchasing, requesting, or receiving a product.

  • “Products” refers to all physical goods, handmade items, origami products, custom creations, and other items offered through MyOrigami.com.

  • “Custom Order” refers to any product made, modified, personalized, designed, or assembled according to a customer's particular request.

  • “Released Parties” refers to MyOrigami.com and, to the extent applicable and legally enforceable, its owners, members, officers, employees, agents, contractors, suppliers, service providers, and authorized representatives.

  • “Terms” refers to this agreement and all policies incorporated into it.

3. PRODUCTS, DESCRIPTIONS, AND ORDERS

We make reasonable efforts to describe and display products accurately. However, photographs, descriptions, dimensions, colors, materials, packaging, and other product details may not perfectly represent the final item.

Product appearance may vary because of lighting, photography, screen settings, material availability, manufacturing methods, and the handmade production process.

Customers are responsible for reviewing available product descriptions, photographs, dimensions, materials, and other relevant information before ordering.

All orders are subject to acceptance, availability, and these Terms. Submission of an order does not guarantee acceptance or fulfillment.

4. RIGHT TO REJECT, REFUSE, CANCEL, OR DISCONTINUE ANY ORDER

MYORIGAMI.COM RESERVES THE RIGHT TO REJECT, REFUSE, CANCEL, LIMIT, OR DISCONTINUE ANY ORDER OR ORDER REQUEST, INCLUDING CUSTOM ORDERS, AT ANY TIME, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

This right may be exercised for reasons including, but not limited to:

  • Product or material unavailability.

  • Production limitations or inability to complete a requested design.

  • Custom requests that cannot reasonably be fulfilled.

  • Pricing, listing, inventory, or technical errors.

  • Suspected fraud, unauthorized transactions, or payment issues.

  • Incomplete, inaccurate, or suspicious order information.

  • Safety, quality-control, operational, or supply-chain concerns.

  • Abusive, threatening, or otherwise inappropriate conduct.

  • Any other legitimate business reason permitted by law.

Submitting a custom request, communicating with us about a design, receiving an automated confirmation, or requesting a particular product does not guarantee that the Company will accept or complete the order.

Custom designs, concepts, specifications, colors, quantities, and other requested details are subject to our review and approval. We are not obligated to accept every custom request or undertake work that we determine cannot reasonably be completed.

Where an order has been paid for but is subsequently rejected or canceled by us, we will provide any refund required by applicable law and any additional refund we expressly authorize. This provision does not authorize us to retain payment when applicable law requires a refund.

We may discontinue products, designs, or services at any time, subject to existing legal obligations.

5. ALL SALES ARE FINAL — NO REFUNDS OR RETURNS

ALL SALES ARE FINAL. NO REFUNDS OR RETURNS ARE ACCEPTED, EXCEPT WHERE REQUIRED BY APPLICABLE LAW OR EXPRESSLY AUTHORIZED BY MYORIGAMI.COM.

By completing a purchase, you acknowledge and agree that:

  • We do not accept returns for changes of mind, buyer's remorse, accidental purchases, or personal preference.

  • We do not provide refunds because a customer dislikes a product's appearance, style, color, size, design, or other subjective characteristic disclosed or reasonably apparent before purchase.

  • We do not accept returns or issue refunds merely because a handmade item differs slightly from a photograph, sample, or another handmade item.

  • Custom orders are final once accepted, subject to applicable law and any express written agreement.

  • Customers should review their selections, shipping details, product descriptions, and custom specifications carefully before submitting an order.

Our limited replacement policy for verified damaged or defective products is described below.

If we reject or cancel an order, any refund required by law will be handled in accordance with applicable law. Nothing in this section eliminates a consumer right or remedy that cannot legally be waived.

6. DAMAGED OR DEFECTIVE PRODUCTS — REPLACEMENT POLICY

Although all sales are final, we will review requests involving products that arrive damaged or defective.

Customers must contact us within 14 days of delivery and provide:

  1. The order number.

  2. Clear photographs of the damaged or defective product.

  3. Photographs of the packaging, if relevant.

  4. A written description of the damage or defect.

Send all requests to:

myorigamibox@gmail.com

Requests will be reviewed to determine whether the issue qualifies under this policy. We may request additional photographs or information reasonably necessary to assess the claim.

For a verified damaged or defective product, we may provide a replacement for the affected item, subject to applicable law.

We do not offer refunds or accept returns under this policy, except where required by applicable law.Replacements are the Company's standard remedy for verified damage or defects to the extent legally permissible.

Minor aesthetic variations associated with handmade production do not automatically constitute a defect. However, this policy does not exclude a material defect, failure to conform to an express description, or other nonconformity that applicable law requires us to address.

Requests received after the 14-day notification period may be denied where legally permissible.

7. HANDMADE PRODUCTS, VARIATIONS, AND CUSTOMER EXPECTATIONS

MyOrigami.com offers handmade and handcrafted products. Because these products are created or assembled by hand, individual items may have unique characteristics.

Customers expressly acknowledge that handmade products may vary in:

  • Color, shade, tone, and appearance.

  • Shape, dimensions, proportions, and alignment.

  • Folds, patterns, texture, and finish.

  • Material characteristics and presentation.

  • Packaging and other aesthetic details.

Product photographs are provided for illustrative purposes. Lighting, photography, display screens, material differences, and the handmade production process may affect how a finished product appears.

The item received may not be identical to a photograph, sample, previous purchase, or a customer's personal expectations.

Minor handmade variations, personal preferences, subjective dissatisfaction, and differences that do not constitute a material defect or legally actionable nonconformity do not, by themselves, entitle a customer to a refund, return, or replacement.

Customers are encouraged to contact us before purchasing if they have questions about a product's appearance, materials, dimensions, or customization options.

This section does not excuse a material failure to provide the product described or eliminate any nonwaivable rights under applicable law.

8. CUSTOM ORDERS AND PERSONALIZED PRODUCTS

Custom products may require additional planning, design work, materials, labor, and production time.

All custom orders are subject to approval and acceptance by MyOrigami.com. We reserve the right to reject any proposed custom order or discontinue a custom project where permitted by law.

Customers are responsible for providing accurate custom specifications, reference images, measurements, color preferences, and other requested details.

Customers acknowledge that handmade custom products may contain reasonable variations from digital mockups, reference images, verbal descriptions, or preliminary concepts.

Unless otherwise expressly agreed in writing, custom orders are subject to the same final-sale, no-refund, no-return, and replacement policies as other products.

We are not responsible for a customer's subjective dissatisfaction with an approved custom design where the delivered item materially conforms to the agreed specifications and applicable law.

If we reject or cancel a paid custom order before completion, any refund required by law or expressly authorized by us will be handled accordingly. Nothing in this section permits us to disregard mandatory consumer protections.

9. PRODUCT USE, SAFETY, AND CUSTOMER RESPONSIBILITY

Customers are responsible for using products according to their intended purposes and any instructions, warnings, or limitations supplied with them.

Customers must not misuse, improperly modify, or use products contrary to applicable instructions or safety warnings.

To the extent permitted by law, MyOrigami.com is not responsible for injury, damage, or loss caused by a customer's misuse, unauthorized modification, failure to follow provided instructions, or use contrary to applicable warnings.

Customers are responsible for determining whether a product is suitable for their intended use and for providing appropriate supervision where necessary.

Nothing in this section waives liability for a product defect, failure to provide legally required warnings, or other conduct for which applicable law imposes responsibility.

10. ASSUMPTION OF RISK AND RELEASE OF LIABILITY

To the fullest extent permitted by applicable law, customers acknowledge and accept the ordinary and reasonably foreseeable risks associated with the proper handling, display, storage, assembly, and use of products, taking into account the nature of the particular product and any applicable warnings.

To the extent legally enforceable, customers release the Released Parties from claims arising from customer misuse, unauthorized modification, failure to follow provided instructions, or other conduct attributable to the customer.

To the extent permitted by applicable law, this release also applies to claims based on ordinary negligence only where the release is legally enforceable and sufficiently clear to cover the conduct at issue.

This provision does not release or exclude liability where applicable law prohibits such a release, including liability that cannot legally be waived for personal injury, defective products, gross negligence, intentional misconduct, fraud, or other nonwaivable claims.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, the Released Parties will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of the Website, the purchase or use of a product, a custom order, or a customer's dissatisfaction.

Where legally permissible, liability for a covered claim shall be limited to actual, direct damages legally recoverable for that claim. To the extent permitted by law, the maximum aggregate liability of MyOrigami.com for a claim relating to a particular order shall not exceed the amount paid to MyOrigami.com for the product giving rise to that claim.

These limitations apply only to the extent legally enforceable. They do not exclude or limit liability for personal injury, property damage, defective products, fraud, intentional misconduct, or other claims where such exclusion or limitation is prohibited by law.

Nothing in these Terms guarantees that a customer cannot file a claim or initiate legal proceedings. Covered disputes are subject to the arbitration provisions below to the extent the arbitration agreement is valid and enforceable.

12. INDEMNIFICATION

To the extent permitted by applicable law, customers agree to be responsible for losses, claims, liabilities, and reasonable expenses arising from their unlawful use of the Website, violation of these Terms, infringement of another person's rights, or misuse of a product.

This provision does not require a customer to indemnify the Company or any Released Party for that party's own conduct to the extent such indemnification is prohibited by law.

13. PAYMENTS, PRICING, AND TAXES

Customers agree to pay the prices, shipping charges, taxes, and other amounts disclosed at checkout.

Customers represent that they are authorized to use the payment method submitted with an order.

We reserve the right to correct pricing, listing, or technical errors and to reject or cancel affected orders where permitted by law. Any refund required as a result of cancellation will be provided in accordance with applicable law.

Customers are responsible for providing accurate payment and billing information.

14. SHIPPING AND DELIVERY

We make reasonable efforts to process and ship orders within the timeframes communicated on the Website. Delivery estimates are not guarantees unless expressly stated otherwise.

Shipping and delivery may be affected by carrier delays, weather, supply interruptions, or other circumstances beyond our reasonable control.

Customers are responsible for providing accurate shipping information. Contact us promptly if a product arrives damaged or defective, following the process in Section 6.

Nothing in this section excludes obligations imposed by applicable law.

15. INTELLECTUAL PROPERTY

Website content, including text, graphics, logos, photographs, product descriptions, designs, and other materials, is owned by or licensed to MyOrigami.com and is protected by applicable intellectual property laws.

Customers may use Website content for personal, noncommercial purposes in connection with shopping on the Website. Reproduction, distribution, modification, publication, sale, or commercial exploitation without prior written permission is prohibited except as permitted by law.

Third-party trademarks remain the property of their respective owners.

16. PROHIBITED USES

Customers agree not to:

  • Use the Website for unlawful, fraudulent, or deceptive purposes.

  • Interfere with the security or operation of the Website.

  • Attempt unauthorized access to accounts, systems, or data.

  • Copy, scrape, or commercially exploit Website content without authorization.

  • Submit false order information or fraudulent claims.

  • Infringe upon the intellectual property or rights of others.

We may restrict or terminate access to the Website for violations of these Terms, subject to applicable law.

17. THIRD-PARTY SERVICES

The Website may contain links to third-party websites or use independent payment processors, shipping providers, and other service providers.

Third parties may operate under their own terms and privacy policies. We are not responsible for independent third-party content or practices except to the extent responsibility cannot legally be excluded.

18. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Website and its content are provided on an “as is” and “as available” basis.

We do not guarantee uninterrupted or error-free Website operation or that every listing, description, or item of content will always be complete or error-free.

Nothing in these Terms disclaims an express warranty we provide or an implied warranty or consumer protection that cannot legally be excluded.

19. EXCLUSIVE BINDING ARBITRATION IN FLORIDA

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

To the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to MyOrigami.com, these Terms, a purchase, a product, a custom order, product appearance or quality, alleged injury, property damage, dissatisfaction, or the relationship between a customer and the Company shall be resolved exclusively through final and binding individual arbitration in the State of Florida, rather than through a court trial, except where applicable law provides otherwise.

This agreement is intended to cover claims against MyOrigami.com and, to the extent legally enforceable, claims involving the Released Parties identified in these Terms.

A. Mandatory Individual Arbitration

Covered disputes shall be submitted to a neutral arbitrator. Arbitration shall be administered by an established arbitration provider under its applicable consumer arbitration rules and applicable law.

The parties may agree on an arbitration provider. If they cannot agree, the provider shall be selected as provided by applicable law.

The arbitration shall take place in Florida, subject to applicable law and any mutually agreed remote-hearing arrangements permitted by the applicable rules.

B. Waiver of Court Trials and Class Actions

To the fullest extent permitted by law, each party waives the right to have covered disputes decided by a judge or jury in court.

Covered claims must be brought individually and not as a class, collective, or representative action, to the extent such waiver is enforceable.

Nothing in this provision eliminates a right that cannot legally be waived.

C. Florida Law and Arbitration Location

These Terms and covered disputes shall be governed by applicable Florida law and controlling federal law, including the Federal Arbitration Act where applicable.

Arbitration proceedings shall take place exclusively in Florida, subject to applicable law and any agreed remote-hearing arrangements.

D. Arbitration Fees

Arbitration fees and costs shall be allocated in accordance with the applicable arbitration provider's rules and applicable law. Nothing in these Terms requires a consumer to pay fees prohibited by law or that would make the arbitration agreement unenforceable.

E. Court Proceedings Related to Arbitration

A court of competent jurisdiction may be used only for matters that applicable law permits a court to decide, including proceedings to compel arbitration or confirm, enforce, or vacate an arbitration award.

This section does not prohibit a proceeding that applicable law expressly permits outside arbitration.

F. Severability

If any portion of this arbitration agreement is found unenforceable, the remaining provisions shall remain effective to the extent legally permitted. Any unenforceable class-action waiver shall be handled in accordance with applicable law.

G. Acceptance and Legal Advice

Customers may consult an attorney before agreeing to these Terms.

Where required by law, this arbitration agreement must be separately and validly accepted. A purchase or website visit alone will not necessarily establish agreement if the applicable legal requirements for contract formation have not been satisfied.

20. PRIVACY

Use of the Website may involve the collection and processing of personal information. Customers should review the Privacy Policy published on MyOrigami.com for information about our privacy practices.

A separate Privacy Policy should be published and maintained if required by applicable law.

21. CHANGES TO THESE TERMS

We reserve the right to revise these Terms from time to time. Updated Terms will become effective when posted on the Website unless a different effective date is stated or applicable law requires otherwise.

Changes will not retroactively alter rights where applicable law prohibits such changes.

22. SEVERABILITY

If any provision of these Terms is determined to be invalid or unenforceable, it shall be limited or severed to the minimum extent necessary, and the remaining provisions shall continue in effect to the fullest extent permitted by law.

23. ENTIRE AGREEMENT

These Terms constitute the agreement between the customer and MyOrigami.com regarding the Website and the subjects addressed herein, except where a separate written agreement or mandatory law provides otherwise.
